Perverted justice

The gavel: a symbol of judgment and rule of law. It should not be consistent with Don’t tell your mother. But it is when it stands for judicial abuse. What happened to good judgment in America? Or are we left only with scandal?

Portia, a Shakespearean character in the Merchant of Venice, once said, “The quality of mercy is not strained…” Portia was a fictitious character that lived in the mind of Shakespeare. The rest of us have to live in the real world where mercy and compassion beyond reason is an obsession imposed upon us to the perversion of justice. In modern day America the quality of mercy is not only strained; it is also perverted. And this perversion interacts and wreaks havoc on the principles of justice that demand fairness and equal treatment for one and all.

Justice in the Bible and the Constitution

Justice is not a new concept. It goes back to biblical times. The prophet Micah made it our obligation to God when he asked: “…And what does the Lord require of you but to do justly, to love mercy, and to walk humbly with your God?” (Micah 6:8) In the New Testament, Peter speaks up about justice in Acts 10:34, wherein he tells us about God’s justice: “…In truth I perceive that God shows no partiality.” Other translations say that God is not a respecter of persons meaning we all stand equally before a Holy God.

When our Constitution was being written, the concept of justice was imbedded deep within the minds of those who fought a war to earn their right to live as a free and independent people. They understood the injustices of a ruling class that governed over their God-given rights and they also understood that justice had to be fair and equitable or it did not exist. This understanding was in complete harmony with the biblical precept of justice in that true justice is blind and dispersed without partiality. When justice is observed according to its biblical precept, it is fair and demands equal treatment for all. As America deviates further and further from the co-dependent principles of “liberty and justice for all”, it becomes a country of class divisions, including a growing ruling class, a dependent entitlement class, a serf/working class, and a special interest class.

Perverted justice has enabled the elitists ruling in Washington D.C. to emerge as a ruling class. They enjoy a type of specific welfare that would have horrified our Founders. It cannot be emphasized strongly enough that class distinctions that create specific welfare instead of protecting general welfare not only pervert justice but violate the “Equal Treatment” or “Uniformity” clause in our Constitution. This is especially evident when it comes to the equal distribution of taxes, which is a constitutional mandate. Without equal treatment, there can be no justice – not when it comes to taxes, legal violations, or those who represent us.

Perverted justice is clearly seen in Congress’ handling of the many exemptions for Obamacare – including their own and certain special interest groups that have found favor with them for one reason or another. It is even more offensive in Congress’ protection of their own pension plans while whittling down the pensions of our troops, which apparently has relegated our fine heroes to the serf/workers class. And dare I mention the closing of national parks under sequestration while the Congress and the Administration still enjoyed their expensive vacations and all their many perks?

Perhaps the vilest obfuscation of justice can be found in the operating rules of Congress where the majority party lords it over the agenda. For those who have elected representatives that are in the minority party, their voices are subtly silenced. The worst or the best example of this occurred during Obamacare discussions, which Democrats held behind closed doors that locked out Republicans. At that point, Americans with Republican representatives had no representation. In short, it was our modern version of “taxation without representation.”

Of course we all know stories of the perversion of justice exercised in our courtrooms. Most recently an over-indulged young man who killed four others was absolved from his crime on the basis of “affluenza” – meaning his affluent lifestyle absolved him from any wrongdoing because he simply hadn’t been taught right from wrong. In this case, justice was not served either in the form of appropriate punishment to the young man or to the families of the victims who may not have been as affluent. And of course, we shouldn’t forget Eric Holder’s directive to the Department of Justice not to prosecute Black on White crimes. This is another example of perverted justice. Liberty and justice for all should be dispensed to “all” and justice should be blind to class distinctions, the color of one’s skin, or the influence of one’s public standing.

Perverted justice perverts mercy

The perversion of justice in 21st century America goes beyond the halls of Congress or our courtrooms; it also distorts our concept of mercy as well. Mercy is another principle spoken about by the prophet Micah that goes hand-in-hand with justice. Micah tells us this is a quality God requires of us.

Mercy is defined as extending forgiveness to someone who may not deserve it. It paves the pathway for grace and repentance – which are usually good things. When exercised unconstitutionally by government, justice suffers. The recent “affluenza” case is a good example of perverted mercy as well as perverted justice.

God’s principles and precepts of justice and mercy can be documented all throughout Scripture – starting in the Garden of Eden and ending with the Cross. While disobeying our laws should result in the appropriate dispensation of justice, disobeying God’s laws (the Ten Commandments) require the same dispensation. You cannot understand sin if you don’t understand the Ten Commandments. It is why missionaries teach them in the mission field before teaching about Christ’s atonement on the Cross. If God was not a just God, no atonement for sin would have been required. Since atonement was required, God in his mercy provided the vehicle whereby our sins could be forgiven without perverting His justice. At the Cross God’s principles of both justice and mercy were served.

Taxation and perverted justice

Taxation that violates the standards set in our enumerated powers section of the Constitution (Article 1, Section 8) also perverts justice. In many cases our money is dispersed to cover costs such as abortion, which many find abhorrent. This constitutionally inappropriate appropriation of federal funds results in tyranny and enables our representatives to essentially buy votes using our own hard-earned monies. Worse, the favors exchanged for campaign support and votes are in themselves a miscarriage of justice. It results in the favoring of campaign contributors over the average citizen and in the process creates a “special interest” class. The creation of any class, whether it be a ruling class, an entitlement class, a serf/worker class, or a special interest class is a miscarriage of justice. It perverts the concept of “justice for one and for all.”

Thus is the condition prevalent in America today where justice for some is different than justice for others. Justice that differs depending on class is not justice at all. When ruling classes are being created and taxation without representation is usurped by congressional rules of operation; when equal treatment and general welfare under the Constitution is replaced by exemptions and specific welfare; when liberty and justice for all uses standards such as skin color or affluence, justice no longer is being served in these United States. It has become an antiquated phrase – little considered and little understood.

A liberty-loving nation that exercises perverted justice and distorts mercy has a tenuous future. As always, the solution lies in understanding the “Good Book” and turning back to God, His precepts, and His principles. Without Him we will continue to do what is right in our own eyes as well as misunderstand and misapply biblical concepts such as justice and mercy – and as in times of past, national destruction is just around the corner. To do justly, to love mercy, and to walk humbly with your God is not an antiquated idea; it is the one idea that can save America. The biggest problem is that it is required of us both individually and nationally. And we can achieve neither without the intervention of God Himself.[subscribe2]

Excellent commentary! You certainly have a handle on the federal government’s current deplorable state of affairs! Without a doubt their corrupted system of justice is out of whack.

At one point in your commentary, you reminded me of an explanation I offered of [good and virtuous] “politics” in a recent radio talk show “FULL CONTACT” interview with the distinguished columnist and author, Erik Rush. Somewhere in the close to 40 minute interview I quoted part of Webster’s 1828 dictionary definition. It’s a definition that has not been found in the 5 years of the Obama White House occupier usurping government.
